To often injured workers do not know the rights that they have under the Nebraska Workers’ Compensation Act. This lack of knowledge many times prevents injured workers’ from receiving the benefits and resources that would otherwise be available. 

Some of the most important rights that injured workers should know are:

1.  Proper weekly wage.

In many cases, the weekly wage is not properly calculated by your employer. This can reduce the amount of benefits that you are entitled to receive.  A thorough review of your wage history is important to determine the proper average weekly wage.

2.  Your right to choose your own treating physician.

Injured workers are often directed to see physicians regularly used by the workers compensation carriers. These physicians may or may not have your best interest at heart. You should always know under what circumstances you have the right to select your own treating physician.

3.  Your right to work within you physical limitations and restrictions.

After an injury, an injured worker may be forced to return to work and perform physical activity beyond his physical limitations and restrictions.  An injured worker should be aware of the right to receive benefits if the injured worker is not able to perform the work because of the restrictions.

4.  Your right to select your own vocational counselor.

Too often, the workers’ compensation carrier will refer an injured worker to a vocational counselor who has been regularly employed by the carrier.  Know that you have the right to select a vocational counselor who can objectively assist in returning you to gainful and suitable employment.

5.  Your right to a loss of earning capacity assessment.

It is often the case that an injured worker sustains a whole body injury and is not advised of the right to have a loss of earning capacity assessment performed to determine earning power loss. A fair and objective loss of earning capacity assessment is critical to obtaining the proper amount of benefits due as a result of the injury.
